What is a Trademark?

A trademark is a recognizable sign, symbol, or expression that identifies one’s business products and services from the other.

The registration of trademarks is now officially with the Commercial Law Department in the Ministry of Trade and Investment in Nigeria, according to the law in Nigeria under the Trademarks Act Chapter 436 of 1990.

Requirements for Trademark Registration

1. Applicant’s full name, nationality, and physical address.

2. The information about the trademark; must have a clear and separate representation. N/B: For trademarks registered online, soft copies in JPEG format at a minimum of 1200 dpi will be requested.

3. For registering your goods in Nigeria, note that the standard used is the International Classification of Goods.

4. Power of attorney signed with full details of name(s), address(s), and nationality of applicant(s), also the name(s) and capacity of the signatory when the applicant is a company/firm.

Procedures for Trademark Registration

1. Instruct your application for trademark registration to a local Attorney/Agent in Nigeria who files and processes such applications at the Nigerian Registry of Trademarks, Patents, Designs, and Copyrights.

2. After the application, the registrar then issues an official acknowledgment which reflects the number and filing date of the application.

3. They carry out a thorough search to confirm the trademark is unique from existing or pending registration. After the search, if the trademark is accepted, they will issue the applicant a letter/notice of acceptance.

4. They must advertise the trademark application in the Nigerian Trademark Journal for two months and is open for opposition for that period.

5. If there are no objections, the registrar will issue the applicant a certificate of registration.

Note: They can register your trademark in either black and white or colored.
